The Content of this website is not intended to be a substitution for professional medical advice, but is solely a source of general information. A User or Registered Patient should always seek the advice of a licensed physician or other qualified health practitioner when faced with questions, illnesses, or other conditions, including the suitability or effectiveness of treatments, including those involving marijuana and cannabis oil products.

Users and Registered Patients of this website understand and agree that TerrAscend Canada Inc. is not responsible for, and hereby waive any and all claims against TerrAscend Canada Inc., with respect to any personal injury, including death, or any damages whatsoever and however caused, arising from User or Registered Patient reliance on the Content or arising from any particular course of treatment for Registered Patients.

2.0 Using the Website

A) How To Use the Website

Feel free to view and print out content for non-commercial use, but you may not copy reproduce, modify, collect, republish, distribute, or catalogue any of our content.

While we work tirelessly to ensure our information is correct, the industry is still being heavily researched and is ever-changing. Therefore please keep in mind that we will not take any liability for any loss or damage resulting from reliance on the content of any kind.

B) How To Access the Store

As of right now, our store is only for Registered Patients of our company. After registering as a patient through your submission, and our acceptance of, a Patient Registration Form, you will be able to create an Account which will grant you access to our store.

Submission of a Patient Registration Form confirms a patient’s acceptance of the Terms and the Patient Registration Terms and Conditions. If you have an issue with these terms or the Patient Registration Terms and Conditions please contact us before completing registration.

C) How To Create an Account

Instructions will be made available after being confirmed as a Registered Patient. During the registration process for an Account, Registered Patients will be required to create a password, and user identification (a “Username”). The password and Username will identify each Registered Patient and associate them with a specific Account.

D) Account Rules

Registered Patients are responsible for maintaining the confidentiality of their individual passwords, and are fully responsible for all activities that occur under their Accounts.

No Registered Patient may share access to their Account, or its associated access to the Services. Sharing of an Account is not permitted

You must immediately notify us of any unauthorized use of their Account and, in the interest of security, ensure that they log out from their Account at the end of each session.

Each Registered Patient is responsible for all activities performed using their Account. We have no liability whatsoever for any loss, liability, or damage arising from any failure to comply with the Terms.

3.0 Prohibited Use of the Website

No User may use the website, its content, Services, or any combination thereof:
• for commercial reasons;
• for illegal purposes;
• in a manner that may damage, disable, overburden, or impair the website or its security, including through use of viruses or other destructive files or programs;
• in a manner that interferes with any other User’s enjoyment of the website;
• with the intention of copying or monitoring the content, including by automated device or software; and

We disclaim all representations, warranties, and conditions, express or implied, with regard to merchantability, merchantable quality, durability, fitness for a particular purpose, non-infringement, and timeliness of any product or the Services, though additional warranties and representations may be provided for specific products, either by us, or by their manufacturers. We do not warrant that the website, its servers, the content, and any communications from us are free of viruses or other harmful components. Use of the website is at a User and/or Registered Patient’s sole risk.

Users and Registered Patients agree that we are not responsible or liable for any claims whatsoever including, without limitation, damages for loss of use, data, profits, or other intangible losses, related to, or arising from, directly or indirectly, use or inability to use the website, use of or reliance on the content, or any other matter related to the website.

To the maximum extent permitted by law in no event will we be liable to any User or Registered Patient for any damages whatsoever, including but not limited to, direct, indirect, incidental, punitive, exemplary and consequential damages arising out of or related to its website, products, User and Registered Patient use, inability to use, or the results of use of, its website or any Services (or on their reliance on any content or Services), whether based on warranty, contract, tort or any other legal theory and whether or not advised of the possibility of such damages. In the event that we are determined by a court of competent jurisdiction to be liable to a User or Registered Patient and the foregoing limitations and exclusions are not held enforceable, then our total maximum aggregate liability for any and all claims and damages shall be limited to fifty dollars ($50.00). The entire risk as to the results and performance and use of the website, products and any content provided is assumed by any User or Registered Patient, as applicable.

It is expressly understood and agreed that we are not responsible for any indirect, special, incidental, consequential, or punitive damages whatsoever and howsoever caused, arising out of or in connection with the use or misuse of the website or in reliance on the content available on the website, whether in an action of contract, civil liability, negligence, or other tortious action, even if we have been informed of the possibility of such damages or such damages are reasonably foreseeable.

Every User and/or Registered Patient acknowledges and agrees that these limitations on liability are reasonable and just in the circumstances.

5.0 Personal Information

Any personal information provided to us by a User or Registered Patient may be collected, used, and/or otherwise disclosed in accordance with our Privacy Policy.

6.0 Rules and Limits for Products and Services

All sales of products and services on our website are subject to availability and applicable regulations, and we may limit availability as we see fit, including for specific Registered Patients. We may also refuse to accept new Registered Patients at our discretion, and refuse new orders from existing Registered Patients.

Order quantities for products are subject to limits as provided by law and regulations. If an order exceeds these limits, we will be unable to process it, and it will be refused.

All prices on the website are subject to change.

All sales are final. No returns or exchanges are available to Registered Patients.

In the event that a Registered Patient has insurance coverage for the purchase of any of our products or Services, we can invoice your insurer directly for the covered amount, as long as they agree. Any such insurance claim shall be subject to any limitations imposed by the insurer. In such event, the Registered Patient hereby consents to the disclosure by TerrAscend Canada Inc. of any information as the insurer may require in obtaining such approval and/or processing an insurance claim.

If a Registered Patient is unsatisfied with a Service or associated product for any reason, they should contact TerrAscend Canada Inc. within thirty (30) calendar days of receipt of the product to address their concerns.

7.0 Violation of Terms

If a User or Registered Patient breaks any of the terms or our other rules and regulations, including by association, we reserve the right to terminate their access to the website, its content, Services, and Accounts.
